Faced with such a broad phenomenon, the piece focuses on two elements that may help to assess this circumstance: the existence of a minimum standard with respect to living space, and the use of tools to establish the existence of harm caused by inhuman conditions of incarceration. The article will show novel jurisprudence of some Courts to secure reparation for victims (early release and reduction of sentence time as offsetting) and will address discussion on the scope and limitations of these decisions with the aim of proposing even more courageous measures to ensure group and generalised reparation measures to reduce the rates of structural institutional violence in prisons.

This article presents a discussion concerning the role of police rationale(s) in Spain within the... more This article presents a discussion concerning the role of police rationale(s) in Spain within the context of the Covid-19 pandemic, where exceptionalist strategies aimed at curtailing the spread of the virus came to dramatically strengthen existing social divisions. In line with some authors who have already approached this phenomenon from different disciplines, our premise is that most serious emergencies boosted by Covid-19 were not a mere matter of public health, but rather a particularly harmful expression of accumulation by dispossession. Thus, rather than a flaw in the system produced by an exceptional friction between public security and public health, securitarian performances deployed by neoliberal states can be read as symbiotic strategies, from both law and order and business as usual approaches, to manage the social “externalities” of capitalist predatory strategies. This article highlights the destructive connections which exist between the financial crisis and state-corporate crimes; specifically, it focuses upon the criminal symbiosis between private banking and political power, in the contexts of both the state's financial crisis and in the participation of private banking in financing the Spanish military industry.

Kirchheimer son los autores de una obra fundamental para comprender el papel de los aparatos punitivos en la historia del capitalismo 4 . Guerra, producción, explotación, fuerza de trabajo y ejército de reserva siguen siendo términos imprescindibles para comprender la evolución de las cárceles y sus clientelas. Se trata, no obstante, de términos no suficientes para responder a las siguientes preguntas: ¿por qué, tras un auge sostenido durante décadas, desciende ahora la población penitenciaria (Karstedt: 2013) en tantos países del occidente desarrollado?; ¿cuál es la diferencia entre aquella progresión -que sobrevivió indistintamente a períodos de bonanza y recesión-y su actual reversión?; ¿se trata de un auténtico cambio de tendencia o de un "descanso" de los dispositivos de control y represión? ¿Hasta cuándo se mantendrá y en qué nuevo escenario desembocará ese descenso?; ¿cómo afecta a las condiciones de vida de la población carcelaria? Y por último: ¿asistimos a una moderación de las estrategias punitivas o a su simple adaptación al nuevo ciclo? Es muy probable que la segunda hipótesis sea la correcta. De una parte, los dispositivos del sistema penal no se moderan en absoluto sino que se modulan 5 . De otra parte, la gestión punitiva del conflicto en el Estado español -y en toda Europa occidental-se ha topado, cara a cara, con un obstáculo desconocido desde los años ochenta -setenta en EEUU: los límites presupuestarios derivados de una crisis fiscal inducida por las políticas de ofertahermoso eufemismo para las políticas de expolio-durante los últimos treinta años. La lectura de todo proceso local sólo cabe en un marco global. No nos encontramos ante una fase terminal del sistema de producción y organización capitalista. El "capitalismo senil" muestra serias debilidades es el régimen de gobierno encargado de habilitar, Aquí y Ahora, las condiciones para el despliegue ininterrumpido del capitalismo.
