The Board of Trustees of the University of Illinois is the legal name of the University of Illinois System. The system is a body corporate and politic of the State of Illinois, created by statute in 1867. The organizing statute is now codified at 110 Illinois Compiled Statutes (ILCS) 305, known as the University of Illinois Act. Federal Taxes The University of Illinois System is an instrumentality of the State of Illinois and, as such, its income is exempt from federal income tax under the provisions of Internal Revenue Code (IRC) §115. In addition, the Internal Revenue Service (IRS) has recognized the system as exempt from federal income tax as an organization described in IRC §501(c)(3) and as a public charity of the type described in IRC §§ 509(a)(1) and 170(b)(1)(A)(ii).
