Consumer Intervenor Compensation Fund
Background
Public Act 102-0662
was enacted by the General Assembly with an effective date of September 15, 2021. The Act provides for a Consumer Intervenor Compensation Fund (“CICF”). A consumer interest representative is eligible to receive compensation from the CICF if its participation includes lay or expert testimony or legal briefing and argument concerning the expenses, investments, rate design, rate impact, or other matters affecting the pricing, rates, costs or other charges associated with utility service, the Commission adopts a material recommendation related to a significant issue in the docket, and participation caused a significant financial hardship to the participant.
In order to implement these provisions of the Act, which are found in Section 9-229 of the Public Utilities Act, the Commission amended Code Part 288 of Title 83 of the Administrative Code (now titled “Utility Rate Case Expense and Consumer Intervenor Compensation Fund”). Those amendments were informed by feedback from

participants and approved by the Commission via its Final Order in
ICC Docket No. 22-0238
Code Part 288.200(b) requires, among other things:
The Administrator shall, by July 1, 2023, publish a standard application and disclosure form required from all CIRs requesting funds according to this Subpart.
