On July 1, 2008, the Illinois Commercial Safety Towing Law ("Law"),
625 ILCS 5/18d-101 et seq.
The Safety Towing Law regulates all damaged or disabled vehicle relocations conducted in Cook, DuPage, Kane, Will and Winnebago counties. The Law applies to all Illinois Safety Relocators, regardless of where their base of operation is located, if a damaged or disabled vehicle relocation is performed in the 5 regulated counties.
According to Section 18d-115 of the Law, safety towers that conduct damaged or disabled vehicle relocations in the above named counties are required to register with the Illinois Commerce Commission.
Disclosure forms required by the Law must be approved by the Commission. To assist safety towers, the Illinois Commerce Commission has developed pre-tow disclosure and complaint forms. If safety towers use these forms, they do not need to seek Commission approval prior to use. Please note, the use of these pre-approved forms is not required. However, if a safety tower wishes to use an alternate form, as stated above, it must be approved by the Commission before use. Duplication and printing of the required forms are the responsibility of the safety tower.
On January 1, 2026, amendments were made to the Safety Towing Law. If a safety tow is conducted without a registration or if a tow truck owner has unpaid fines to the ICC, the tow truck is subject to impoundment.
Special Note
: In Professional Towing & Recovery Operators of Illinois v. Box
, 965 F.Supp.2d 981 (N.D. Ill. 2013), a federal court ruled that several provisions of the Safety Towing Law are preempted by federal law and must be removed. The following provisions of the Safety Towing Law are not enforceable by the ICC:
625 ILCS 5/18d-120(a) – safety tower shall not conduct a tow of a damaged or disabled vehicle without specific authorization from vehicle owner after certain disclosures have been provided.
625 ILCS 5/18d-125 – upon demand, a safety tower must provide an itemized written final invoice to the vehicle owner or operator of the damaged or disabled vehicle.
625 ILCS 5/18d-150 – safety tower is prohibited from including a waiver or limitation of liability in contracts for relocation or storage of vehicles.
625 ILCS 5/18d-165 – towing and storage fees shall be payable by use of a credit card, in addition to cash.
The remaining sections of the Safety Towing Law are enforceable by the ICC and are related to safety with respect to motor vehicles and financial responsibility.
